Samsung has moved to add the iPhone 5 to the list of Apples devices it alleges infringe on its telecoms patents in the latest move in the ongoing legal battle between the two firms.
The firm issued the order in the US on Monday and in a statement sent to V3 claimed it was pushed into the action by Apple's legal challenges.
"We have always preferred to compete in the marketplace with our innovative products, rather than in a courtroom. However, Apple continues to take aggressive legal action that will restrict market competition," it said.
"Under these circumstances, we have little recourse but to take the steps necessary to protect our innovations and intellectual property rights."
Apple had not responded when contacted for comment on Samsung's move.
In its filing Samsung explained it was basing the order on the same issues it had with older iPhones, revealing that it first informed Apple of its intention to sue on 28 September.
"Samsung obtained an iPhone 5 on September 21, 2012, and immediately began investigating whether the iPhone 5 practiced [used] its patented technologies."
"Because the iPhone 5 has the same accused functionality as the previously accused versions of the iPhone, Samsung seeks, with its proposed amendment, to add the iPhone 5 as an accused device that infringes Samsung's [patents]."
The patents relate to numerous capabilities including data upload technology, audio and video controls, cross-device syncing of information and recording tools.
However, Apple has fended off most legal challenges sent its way by Samsung, including cases lodged against the iPhone 4S when it first came out in Italy and France last year.
The move comes on the same day that Samsung won a court order temporarily overturning a US sales ban on its Galaxy Tab 10.1 tablet.
