The Motorola Xoom could swiftly follow Samsung's Galaxy Tab 10.1 device by being banned in the European Union, after it emerged that Apple filed a complaint with the same German court over the design of the tablet.
Legal experts told V3 that the Tab could technically be seized at UK ports after Apple's successful preliminary injunction was granted by a Düsseldorf court on Tuesday, applying to all EU countries except the Netherlands.
Now patent expert Florian Mueller has discovered a passage in the Samsung complaint that mentions two other lawsuits filed by Apple, one against German vendor JAY-tech and the other against Motorola.
"That passage says that Apple filed with the same court (district court of Düsseldorf) a complaint over the design of the Motorola Xoom, but it doesn't state whether that complaint included a request for a preliminary injunction," Mueller wrote in a blog post.
"While it's not stated explicitly, I suppose that the complaint against Motorola also asks the court for an EU-wide injunction - but perhaps just for a permanent injunction without a previous preliminary one."
Mueller argued that Apple may not be able to file a preliminary injunction against the Xoom in Germany as it has known about the design of the device for too long.
"It's possible to get permanent injunctions even against older products, but for preliminary ones there must be a particular sense of urgency," he added.
The European dispute with Motorola is the latest front in a long running legal battle between Apple and Motorola dating back to last year, which has seen the firms suing each other over more than 40 US patents
