The lawsuit filed against Hewlett Packard (HP) by Walter Hewlett has been issued a trial date of 23 April.
But it will only go to trial if HP's plea to dismiss the suit is rejected on 7 April by Delaware Chancery Court Judge William Chandler III.
Hewlett has called on the courts to overturn the HP shareholder vote based on his concerns over how the company got votes approving the proposed merger from large institutional stockholders.
Hewlett is particularly concerned over the votes cast by Deutsche Bank.
