IT organisations face increased risk of lawsuits if they aggressively target their competitors' staff, research company Gartner has warned.
The US based company said corporations need to take care if they solicit their competitors' staff without being approached, and value them more for their insight into competing strategies rather than for their experience.
The warning comes as SAP last month filed suit against Siebel systems in the US federal court, alleging that two former SAP executives left with knowledge of confidential information when they went to work for Siebel.
SAP maintains that Siebel's hiring of two high level executives is tantamount to stealing proprietary insights into SAP's strategy.
Gartner said that lawsuits of this type are likely to become more common as companies get more serious about protecting strategies, knowledge and core processes.
However, Gartner also warned that by threatening to issue lawsuits in these cases, companies that lose employees render themselves as unappealing employers.
Gartner analyst Colleen Young commented: "Enterprises that plan to hire business or IT professionals in the hot ebusiness market should get candidates to agree, in writing, that they are not breaching confidentiality agreements, and do not possess proprietary documents or materials from previous employers."
She added that companies should have candidates sign confidentiality agreements specifically for the enterprise and be prepared for the possibility of litigation.
Separately, Software Technologies Corp. (STC) is next week expected to announce new software designed to help customers more easily connect SAP business applications to Siebel's sales and marketing applications.
