Microsoft sues DHL over Xbox train crash

Software giant goes to court after derailment destroys $2m worth of consoles

Microsoft is filing a suit against shipping company DHL over an Xbox shipment delay caused by a train derailment.

The company claims that DHL has refused to reimburse it for more than $2m in damages incurred when a freight train carrying more than 20,000 consoles derailed in Texas in October 2007. The shipment was reportedly destined for Hong Kong.

Microsoft contends that, in addition to damage from the accident, the consoles were pilfered and exposed to the weather.

The company is seeking repayment for the damage to the consoles as well as losses incurred in the aftermath of the incident.

Microsoft alleges that DHL "negligently breached its duties as a common carrier, handler, bailee, warehouseman, agent, or in other capabilities".

DHL has yet to issue a statement on the allegations.
