Dell is being sued by the State of New York for allegedly misleading customers on pricing, offering poor service, passing off second hand parts as new and encouraging users to break their own warranty agreements.
In a damning indictment Dell has been accused of using "bait and switch" financing tactics by advertising "no interest" and/or "no payment" machines and then refusing them to the vast majority of customers, even those with very good credit scores.
The company then passed the customer over to its Dell Financial Services arm which offered payment plans with interest rates of up to 20 per cent.
Dell is also accused of providing very poor customer service to those who bought expensive service contracts.
In several cases the company allegedly encouraged users to void their warranties by removing the PC's cover and removing and reinstalling parts.
New York Attorney General Andrew Cuomo said: "At Dell, customer service means no service at all. Dell's consumers were intentionally misled, and they had to pay for that privilege.
"I hope this lawsuit sends a message to companies large and small that delivering a product is simply not enough. The promises they make must be delivered as well."
For those who purchased on-site warranties the suit alleges that service reps repeatedly failed to turn up on time, that the free helpline was seldom answered and that second-hand parts were used to effect repairs.
Dell Financial Services is also accused of making illegal deductions from customer accounts, failing to credit money when it was owed and harassing customers.
In filing the lawsuit, Cuomo is seeking to require Dell and Dell Financial Services to pay restitution to aggrieved consumers and civil penalties, and adopt measures to ensure that they do not engage in deceptive, illegal and fraudulent practices in the future.

Mis-leading Finance
This has just happened to me in the UK, back in October 2007 I purchased a new Dell Inspiron 530, at the time they were offering buy now pay 12 months later. When I applied for the credit I was told they could offer it to me but I could have 6 months, even though I was little disappointed I signed up anyway. I have just paid the amount in full within the six months time and today received a letter in the post saying I owe them £78.60. I have written to their customer service department but no reply yet. Looks like I might have been mis-sold and tricked into a deferred loan rather than a buy now pay later. I await a reply from Dell Financial Services, if anyone has had the same problems, get in touch.

Dell & Service ...
I used Dell in France for 100 laptops that came with 3 years onsite warranty (paid !) All calls were taken by lowlevel techs asking us to power on the laptop, press this, press that, connect an external monitor... (even if the laptop was with evidence unable to load anything) then asked us to unscrew the hardrive and test it on another laptop (not in stock !!) Non sense "service" and support. All repairs were done by external firms, sometimes coming with the wrong piece (even if we specified to come with the faulty piece WE diag nosed )... Worse, once the external came 4 times: - wrong piece (as suspected) - good piece, but another trouble came - he broke a part when changing pieces - he came with the piece to replace the broken one ==> more than 1 week for a 8h repair !!! Other non service from Dell, what do i car to buy a laptop full of scrap softwares, when I'd like to have it empty ??
