A college student is facing over 20 years in jail and huge fines after guessing the password to the Yahoo email account of then vice-presidential candidate Sarah Palin.
David Kernell was convicted of unauthorised access to obtain information from a computer and obstruction of justice, which comes with a maximum term of 20 years in jail. He was found innocent of wire fraud, and a charge of identity theft was dismissed after a retrial.
Kernell used publicly available information to guess the password to Palin's Yahoo account, namely the location where she met her husband.
At the time, Palin was reportedly under fire for using a private email account for government business and Kernell uploaded certain emails to Wikileaks showing this to be the case.
The defence argued that the incident was little more than a student prank, but the prosecutors said it was a deliberate attempt to sabotage the presidential campaign. Palin and her daughter Bristol testified about the disruption the incident caused to their lives.
"My family and I are thankful that the jury thoroughly and carefully weighed the evidence and issued a just verdict," said Palin in a Facebook posting.
"Violating the law, or simply invading someone's privacy for political gain, has long been repugnant to Americans' sense of fair play.
"As Watergate taught us, we rightfully reject illegally breaking into candidates' private communications for political intrigue in an attempt to derail an election."
Kernell now faces 21 years in prison and fines of $100,000 (£66,000) for computer fraud and $250,000 (£165,000) for obstruction of justice.

He performed a public service - he should have got a medal instead of the threat of jail time. @annoyed - you sure it was a virus that "corrupted" your HD & not your own incompetence. The person under discussion here merely guessed a stupid password - he had zero to do with viruses, botnets etc.

justice is needed
How does hacking an email relate to other crimes ..like lets say being responsible for starting a war that kills more than 100.000 civilians? ... Read 'The Prosecution of George W. Bush for Murder' if you need food for thought about what is right and wrong ...

He is innocent
If he had to take illegitimate use of the email account, he would'nt had publicized the issue. This chap gave a very good example of how the web can be used destructively. It is very sad of the jury giving him such a harsh sentence

David Kernell
It is my opinion that HE should get the max. sentence, he did do a criminal act, hoping not to get caught but he did and daddy can't buy him out of this. Palin has had someone on her back the entire time she has been in public eye. Have you read her book? You should to see the person she is, she has done no harm to anyone. Kernell should spend most of his life looking out of the bars should he be so lucky to have a outside cell. I do not think he should get a slap on the hand. Every persons life is private unless YOU wish to share it with someone. How stupid can someone be=this was no prank=fun=or just something to do=it is and was serious. Let him do the time for the crime.

I agree
Yep he is young and stupid. Why do we consider young ones as full fledged decision makers?

Go Easy
If this kid were a Republican, hacking into Obama's e-mail, he'd be looking at the electric chair. Having said that---I hope the punk gets no more than 2 years. He is still in that "young and foolish" period of his life.
