UK mobile phone maker Sendo is suing Microsoft, accusing it of passing technical secrets to rival handset manufacturers.
According to the BBC, Sendo alleges in documents filed at a Texas court that Microsoft passed information from Sendo to other mobile manufacturers.
In November, Sendo cancelled all co-operation with Microsoft when it was just weeks away from launching a smartphone running on Windows.
Up to that point it had been a key partner in Microsoft's bid to break into the mobile phone market.
Sendo said that it had broken up the partnership because Microsoft would not give it access to its source code, making it impossible to tailor the software used in its devices.
The company went on to sign a contract with Microsoft rivals Symbian and Nokia.
