IPod Nano owner Jason Tomczak and others have filed a class-action lawsuit against Apple in California in an attempt to get their money back for a product which they claim suffers " excessive scratching" during normal use.
According to Red Herring, the complaint cites several users who have made their feelings known about the tiny devices in blogs and on the web.
The lawsuit demands damages, including the price paid for the Nanos, along with statutory and punitive damages and attorneys' fees. They are also audaciously asking for a share of Nano profits.

get a freakin life... how are you going to sue b/c u scratched ur ipod and claim u were lead on that it was more durable by steve jobs pulling one out of his pocket... oh no... god forbid that the cheapest ipod not be as durable as the more expensive ones... duh... some people will just sue over anything they think they can get money out of...

WTF!
how can u sue apple because you havnt taken proper care of ur ipod...every 1 know they scratch all you have to do is get a case....god u americans will sue over anything

if you dont want your ipod to scrath,buy a case for it..duh. i bought a rubber case thing to go on the ipod,now my ipod is scrath-free! :D
